Terms of Service

The terms and conditions apply to the use of this website. When you access this website and/or place an order, you agree to be bound by the terms and conditions outlined.

Using this Website confirms that you accept the terms regardless of whether or not you decide to register with us or purchase from us. If you do not accept the terms, do not use this website.

The website is operated by Petals by Venice located in Victoria, Australia

Any reference in the terms and conditions to “we” or “us” refers to Petals by Venice store.

Our contact email address is petalsbyvenice@gmail.com. We are an online company and do not have a telephone line.

We may change the terms and conditions at any time by updating this terms of service. You should read this terms of service from time to time to be aware of the terms and conditions, because they are binding on you. Certain areas of the terms and conditions may be superseded by expressly designated legal notices or terms found on certain pages of this Website. If you do not wish to accept the terms and conditions, you should not continue using this Website.

Ordering
You are considered to place an order with us by ordering through our online checkout process. We will send you an order acknowledgement via email, describing the items you ordered.

Your order is accepted once the order is paid in full.

While we try our best that every order is completed, sometimes orders may need to be cancelled. You will be unable to cancel your order once your orders is packed and ready for shipment.

Once your item is received we are unable to offer a return or refund if the item sizing is incorrect or printing is incorrect upon customer request. The order will only be recognised as a return if it is deemed faulty by us. If an item is returned as faulty but is checked and is not deemed to be faulty, the order will not be refunded and we reserve the right to charge return postage.

We may refuse to accept an order:

(a) Where items are not available
(b) Where we cannot process authorisation for your payment
(c) If there has been a mistake in pricing or product description
(d) If you do not meet any eligibility criteria set out in the terms and conditions
(e) Following any abusive behaviour that may lead to damage to our business
(g) We do not tolerate any threatening or abusive emails or messages and as soon as we receive these your order will be declined

Delivery
Your items will be delivered to the address which you give us for delivery when you make your order. If any of the information you have provided in your delivery address are incorrect, we are not liable for any items that are not received. On the instance that items are returned to us due to customer inputting their address incorrectly. The customer will incur additional shipping fee to have the items resent.

Your order will be shipped as soon as possible and usually for plain items within 48 hours and made to order items up to 30 business days. Delays are possible during peak season. If you need your items urgently please contact us.

While we try our best to send the items as quickly as possible, we cannot guarantee delivery on that day or be liable for delay in deliveries. We are not liable for out of pocket expenses or other costs incurred because of failed or delayed deliveries.

Most of our items are dispatched via Aus Post shipments to po boxes, express post or some regional items will be shipped through Aus Post. Some items are dispatched through courier sendle. Please ensure to check your junk mail for your shipment tracking information.

We reserve the right to wait up to 12 business days from the date of dispatch before taking further action regarding an undelivered product.

Please note: we will not be liable for any late deliveries if delays occur by causes beyond our reasonable control including, without limitation:- fire; severe weather conditions; industrial dispute; strike or labour disputes

Free Shipping offers are only valid within Australia.

Returns and exchange
We accept returns for exchange only for non personalised products in our store if you change your mind. Return postage is at the customers expense and shipping of replacement items is at the customers expense. Products must be unworn and must be in original state. We do not accept returns for special made to order/personalised products. Return must be within 14 days of purchase date. After 14 days, all sales are deemed final.

If a product is faulty and we deem this as our error, we shall refund or exchange the item upon receiving photographic evidence, we may sometimes request the item be returned for further inspection.

Delivery information can be found on our website. If you need the order sooner and we are not informed by email of the date, we shall continue to process the order inline with our processing times.

Please ensure you allow plenty of time for your order to be processed.

Faulty item
In the unfortunate circumstance that the product arrives damaged or faulty, please contact us as soon as possible within 14 days of purchase date. You need to provide a photo of the fault. We will then inform you on how to proceed with the return. Refunds cannot be given if the fault is as a result of misuse. We do not take any responsibility for washing and ironing of garments. Waking and ironing garments are at your own risk. No refunds will be given if the product is washed or ironed. We will not refund on any products even if faulty once worn. We will need the tracking information if advised to return. If we do not receive the tracking information we will be unable to process a replacement or refund. After 14 days of purchase date, all sales are deemed final.

Colours
Because of different screen colours and tones, the colour of the product may be appear different on different devices. The colour shade you receive may be different to the colour as seen in our website on your computer monitor or mobile device. Please be informed that if a specific shade of colour is important to you, your order is placed at your own risk.

Colours selected by the customer are final, we cannot be responsible for the choices selected by the buyer. We do not replace the products if you are not happy with your colour combinations once personalised.

All products are sold as individual products. Because of the fabric dyeing process involved there could be a slight shade difference with fabric batches. We try as much as possible to match shades when ordered in one transaction however this is not always possible.

While we do our best to photograph our items, monitors can distort the colour quite considerably from what is shown on the computer/mobile device to what is received in person. As with all items we sell, we are unable to guarantee the identical depth of colour across each product, due to batch dying of fabrics. Hence, slight differences in shading is possible especially when you order across multiple time periods or across size ranges. All images on our website are for illustrative purposes only.

Order changes
If you do not receive a confirmation email of a change you are requesting then please do not assume that the change request has been confirm, as your email may not have been actioned. You can cancel your order if it has not yet been processed, however it will incur a 5% cancellation fee which covers payment processing and admin fees.

Discounts & Offers
Offers are limited to one per customer. Multiple discount vouchers are not accepted on the same order. Products that are purchased in a ‘Sale’ cannot have further discounts applied nor can they be returned these products are sold as seen. Sitewide sales are for product only and do not include other services or shipping. Discount codes are not be used in conjunction with other offers

These terms and conditions is governed by and construed in accordance with Australian law. Disputes arising in relation to these terms and conditions shall be subject to the non-exclusive jurisdiction of the Australian courts.

Miscellaneous
You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions.


We are not liable for products damaged during washing or ironing.

If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.

Sale items are non returnable

Some sale items do have defects as listed and will not be removed.

We only accept returns for exchanges on non personalised no sale items. Shipping of returns and exchanged items is a the customer's expense.

Please understand that if you refuse to accept the terms and conditions, you cannot order any products from our website.
